OPEN: Morrison's promoting infant formula

Update 12 May 2014: Despite Morrison's informing NCT it would be removing the promotion from all stores on 6 May, it continues to be reported. For example, in Holyhead on 11 May and Redcar on 12 May

The picture below was taken by a member of the public in Morrison's Porth store at the begining of May and was also found in Reigate on 6 May.

It shows infant formula being promoted with a shelf talker and price reduction.

Such practices are specifically prohibited by the Infant Formula and Follow-on Formula Regulations (2007) (full text in the 'Law' section), which states:

23.  (1)  No person shall at any place where any infant formula is sold by retail—
(a) advertise any infant formula;
(b) make any special display of an infant formula designed to promote sales;
(c) give away—
  (i) any infant formula as a free sample, or
  (ii) any coupon which may be used to purchase an infant formula at a discount;
(d) promote the sale of an infant formula by means of premiums, special sales, loss-leaders or tie-in sales; or
(e) undertake any other promotional activity to induce the sale of an infant formula.
Morrison's promotion demonstrably violates these provisons.
The store manager was told the promotion breaks the law, but apparently he neither welcomed the information nor acted upon it. The monitor reported the case to BFLG members, Baby Milk Action and NCT.
Baby Milk Action has reported the promotion to Trading Standards as other reports continue to come in.
